When a modification is planned for a stationary source, the owner/operator must submit a preconstruction permit application under the new source review (NSR) program. Existing major sources of any “regulated NSR pollutant” [§52.21(b)(50)] must evaluate whether the modification they are doing is “significant” [§52.21(b)(23)] enough to trigger major source NSR permitting for all regulated NSR pollutants. During the second step of this process, sources that fail the first step may “net out” of major source NSR for a pollutant if the net emissions increase of that pollutant over a multiyear time period (i.e., contemporaneous period) is not significant.
