Making hazardous waste determinations is trickier in California than in most other states. When you discard a material, answer these four questions to stay on the right path. [§66262.11]

1. Is it a waste? Many more materials are wastes in the Golden State than are captured under the definition of solid waste elsewhere in the country.

2. Is it excluded? Fewer provisions are available to get a waste out of regulation than what is found in the federal program.

3. Is it listed? Sure, California has F-, K-, P-, and U-wastes, but it also has M-wastes. And don’t forget about the three presumptive lists.

4. Is it characteristic? Ignitable, corrosive, reactive… and eight ways a waste can be toxic.
