Congress–2, CAA–0

For the second time in the CAA’s 55-year history, Congress has acted to weaken the landmark environmental law with the passage of Senate Joint Resolution 31. This joint resolution of disapproval rolls back an EPA rule that required certain stationary sources to maintain compliance with relevant MACT standards. While numerous environmental regulations have been revoked over the years, this is only the second time the U.S. legislature has “overturned” an EPA rule with the intent to weaken the CAA, even though the courts required the rule to be implemented.   READ MORE

California’s Department of Toxic Substances Control recently hosted a webinar covering new hazardous waste rules up for adoption. While some only make minor changes, a few rules are very significant, drastically altering the way waste is managed in the Golden State. Backtracking on MATS emissions

On June 17, 2025, EPA proposed to repeal the May 2024 revisions to numerous emission limits in the mercury and air toxics standards (MATS). [90 FR 25535] The May 2024 rule made the emission limits more stringent and is discussed in a previous article. The proposed repeal would affect the Part 63, Subpart UUUUU revised standard for filterable particulate matter (fPM) emissions, a surrogate for non-mercury metal hazardous air pollutants for existing coal-fired electric utility steam generating units (EGUs); the fPM emission standard compliance demonstration requirements; and the revised mercury emission standard for lignite-fired EGUs. The agency is proposing a few other changes, and comments may be submitted through August 11, 2025 via Docket ID No. EPA-HQ-OAR-2018-0794.

 

 

 

EPA says GHGs don’t pollute

In EPA’s second deregulatory move on June 17, 2025, it proposed to remove all greenhouse gas (GHG) emissions standards for fossil fuel-fired power plants. [90 FR 25752] The agency argues that GHG emissions from fossil fuel-fired power plants do not contribute significantly to dangerous air pollution. Consequently, Part 60, Subparts TTTT, TTTTa, and UUUUb would see their GHG emissions standards removed, even though they were just finalized in May 2024. In an alternative proposal, EPA wants to repeal the Subpart UUUUb emission guidelines in their entirety. Comments may be submitted through August 7, 2025 via Docket ID No. EPA-HQ-OAR-2025-0124.
